Terms and Conditions of Use

01.Nature of Service and Operational Role

Cherry Apply operates exclusively as an assistive technological agent designed to optimize job application workflows. The software acts under the strict initiative and direction of the user, executing secure browser automation routines to interact with various public job boards in a transparent and efficient manner.

02.Usage License and User Responsibility

The user is granted a personal, non-transferable, and non-exclusive license to access the automation and cognitive optimization modules of the software.

As an essential condition for using the software, the user assumes full responsibility for the accuracy, legitimacy, and truthfulness of the professional details provided (including employment history and responses submitted to filtering questions). The software assumes in good faith that all loaded data represents the candidate's actual experience.

03.Interaction with Third-Party Ecosystems

Job application procedures take place locally and directed within the job portals chosen by the user (such as LinkedIn or corporate portals). Each of these platforms is governed by its own terms of service.

The software performs automation actions that are initiated and supervised by the user to assist with form-filling on public interfaces. The user is responsible for using the tool in accordance with each platform's terms of service and releases Cherry Apply from any liability regarding technical resolutions or access policies applied independently by third-party platforms.

04.Technical Warranties and Limitation of Results

The platform provides advanced profile matching and ATS scoring tools. However, under no circumstances do we guarantee specific contractual outcomes, definitive job offers, or interview callbacks. Final recruitment decisions are exclusively and sovereignly made by the employer organizations and their human hiring teams.

05.Data Integrity and AI Inference

Optimizations, summaries, and proposed answers generated by natural language processing models serve as informative tools to boost professional productivity. The user retains the final authority and responsibility to review, edit, or cancel any application submission prior in their control panel.

06.Disclaimer of Warranties ("As Is")

The software is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, uninterrupted availability, or error-free operation. Cherry Apply does not warrant that the service will remain permanently compatible with third-party job platforms, which may change their interfaces, policies, or access conditions at any time and without prior notice.

07.Limitation of Liability

To the maximum extent permitted by applicable law, Cherry Apply, as well as its officers, employees, and suppliers, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, nor for any loss of job opportunities, data, revenue, or reputation, arising from the use of or inability to use the software. In any event, Cherry Apply's total aggregate liability to the user shall not exceed the amount actually paid by such user during the three (3) months preceding the event giving rise to the claim.

08.Indemnification

The user agrees to defend, indemnify, and hold harmless Cherry Apply and its providing company from any claim, demand, penalty, loss, or expense (including reasonable legal fees) arising from: (i) the user's use of the software; (ii) the user's breach of the terms of service of any third-party platform, including LinkedIn, Indeed, or Computrabajo; (iii) the inaccuracy or falsity of the professional information provided; or (iv) the violation of these Terms or any applicable law.

09.Governing Law, Jurisdiction, and Minimum Age

The user represents that they are of legal age and have full legal capacity to enter into this agreement. These Terms are governed by the laws of the Republic of Peru, and the parties submit to the jurisdiction of the competent courts of Lima, without prejudice to any mandatory consumer protection provisions applicable in the user's jurisdiction of residence. Cherry Apply may modify these Terms at any time, providing notice of changes through the service; continued use of the software after such changes constitutes acceptance.
